This is the last will and testament of me John Harvey of Merston in the Isle of Wight
yeoman made this fourth day of December in the year of our lord one thousand eight
hundred and fifty two. I nominate and appoint my son Richard and my friend William
Harvey of Chillerton gentleman executors of this my will. And I direct that all
my just debts funeral and testamentary expenses shall be fully paid with all commercial
speed after my decease. I give and bequeath to my wife Anne the furniture of my
own bedroom at Merstone Farm. I give and bequeath unto my son Richard his executors
administrators and assign all my estate and interest in the farm estate at Merston
aforesaid which I hold as tenant under Admiral Edward Hawker. And I also give and
bequeath to my said son Richard so much of my live and dead stock as he shall choose
within three months after my decease to the value of one thousand pounds only provided
always that the said bequest of the farming stock to my said son Richard is upon
the following conditions namely that he my said son so long as he shall continue
to be the tenant of the said farm shall pay. And I do hereby give and bequeath to
my wife Anne Harvey an annuity of clear yearly sum of forty pounds during her life
and upon her death that my said son shall pay one thousand pounds to my said executors
to form part of and sink into the residue of my personal estate. And I direct that
my said son shall give and execute to my executors immediately after my death a bond
and warrant of attorney for one thousand pounds and that they my said executors shall
cause judgement to be entered up upon such warrant - but that the same shall be conditioned
to be void upon my said son duly paying the said annuity and the one thousand pounds
when and as the same shall become due under the provisions of this my will and immediately
after the decease of my said wife or in case my said son Richard shall at any time
during the life of my said wife cease to be the tenant of the said farm or shall
refuse or neglect to pay the said annuity. Then I hereby direct my said executors
immediately to obtain the repayment of the said one thousand pounds from my said
son Richard his executors or administrators and for that purpose to take legal proceedings
upon the said bond warrant of attorney and judgement aforesaid. And also in case
my said son shall within three months after my decease decline or refuse to choose
one thousand pounds worth of stock as aforesaid then in other of the above cases
I hereby direct my said executors to stand professed of the said sum of one thousand
pounds part of the proceeds of my personal estate. Upon trust to invest the sums
in government or such other securities as shall be satisfactory to my said executors
at interest with power to pay the dividends and interest thereto to my said wife
for the natural life and from and immediately after the decease of my said wife.
Upon trust to pay and divide the money so invested as aforesaid and I do hereby
give and bequeath the same unto and to be equally divided between all my children
absolutely. And I give devise and bequeath all the left residue and remainder of
my seal and personal estate whatsoever and wheresoever not hereinbefore disposed
of unto and to be equally divided between all my children respectively. In witness
whereof I the said John Harvey have at the past or end of this my last will and testament
contained in two sheets of paper subscribed my name the day and year first above
written.
